Employer Nomination Visa – 186 Visa Skill Requirements

ENS 186 Visa Skill Requirements
186 Visa Work Experience Requirements
To be eligible for the 186 Visa, you must have worked for at least three years in your nominated occupation. It must be a full-time work, but does not have to be continuous or occur immediately before the visa application. Full-time work here means you must have worked at least 38 hours a week.
The following situation should be removed from the calculation of the term of employment:
- Any time of employment during which you changed occupations
- unemployed, or
- took extended unpaid leave.
186 Visa Skilled Occupation List
Starting 7 December 2024, the applicable skilled occupation list for 186 Visa is the Core Skills Occupation List. It is applicable for the 186 Visa – Direct Entry stream.
Meanwhile, for the 186 Visa – Labour Agreement stream, your nominated occupation must be on the labour agreement made between the Australian Government and the regional government agency.
Skills Assessment Requirements for 186 Visa
You must submit evidence that your skills were assessed adequate for the occupation at the time of application. A Skills Assessment conducted after the visa application was submitted does not meet the visa requirements. Meaning, the Skills Assessment must clearly demonstrate that your skills were assessed as suitable by the relevant assessing authority no later than the day your visa application was submitted.
Another important thing to note is the validity period. Some skills assessing authorities provide assessments with expiry dates. You fail to meet the Skills Assessment requirement if you submit the expired one.
Meanwhile, the skills assessment without an expiry date is usually valid for three years from the date of assessment. If the three years have passed, the skills assessment will not be valid to meet the 186 Visa requirements.
Employer Nominated Scheme Visa (Subclass 186) Streams
This visa has 3 streams as per below:
Direct Entry Stream
This stream is for someone who has never or briefly worked in Australia and this should be applied from offshore. If you are applying for this stream, you may include your family, which in this case is your partner and your dependent child. The cost of this application is AUD $4,770 for the main applicant.
For the employer itself, the nomination application fee would be $540 AUD and they need to pay the SAF Levy. The processing times may vary between 3 – 12 months.

Criteria for Direct Entry (DE) stream
The applicant should meet the below criteria:
- Have an occupation that is on the Core Skills Occupation List;
- Have at least 3 years relevant work experience, unless you are exempt;
- Have a positive skills assessment unless you are exempt;
- Must be nominated by an Australian employer whose business is actively and lawfully operating;
- Must be under 45 years of age when you apply, unless you are exempt;
- Must meet the health and character requirement;
- Must have at least Competent English.
Temporary Residence Transition Stream
This stream is for someone who held the Skills in Demand Visa (subclass 482). You may apply for this stream rather onshore or offshore. Same as the direct stream, you can include your family and it has the same visa cost.
The employer should be an eligible business, be the applicant’s current sponsor, and should pay the SAF Levy.

Criteria for Temporary Residence Transition Stream
The applicant should meet the below criteria:
- Must hold a 457, SID (subclass 482) or related bridging visa A, B or C;
- Must have worked for your employer full-time for at least three years;
- Must be nominated by your employer;
- Must be under 45 years old;
- Must meet the health and character requirement;
- Must have at least Competent English.
Labour Agreement Stream
This third stream is for someone who has been nominated by the employer and this employer has signed into a Labour Agreement.
The employer should be an eligible business and they should have a current labour agreement.

Criteria for Labour Agreement Stream
As the applicant, you should meet the criteria as per below:
- Must be working under a labour agreement;
- Must be nominated by the employer;
- Must be under 45 years old;
- Must hold a substantive 457 or SID (subclass 482) visa issued under a labour agreement;
- Must meet the health and character requirement;
- Must not have had a visa cancelled or a previous application refused.

- What are the requirements to be able to apply for this visa?

You must have at least Competent English (IELTS score at least 6 each band) before applying unless you are exempted, for example, if you are a citizen of and hold a valid passport issued by the United Kingdom, the United States of America, Canada, New Zealand or the Republic of Ireland.
- How much does this visa cost?
- It costs $4,770 to apply for this visa. Additional charge applies for each family member who is included in your visa application. Furthermore, if any of the family members is 18 years of age and older and does not meet the English requirement (Functional English), you will be required to pay the second installment of $4,890.
- Can I apply for this visa while offshore?
- You can apply for this visa while you are onshore or offshore. You must be on a substantive or related bridging visa if you are applying onshore. When the decision is made for your application, you can also be onshore or offshore.
- How long will the process take place until I got the decision?
- This visa will generally take about 7 to 12 months to be processed, assuming you have met all the requirements and provided all additional information.

Granted a Visa
The processing time estimation will vary for each stream, however, basically, it will take around 4 – 12 months. If your application is successful, you will be granted a visa. You have to start your employment with your employer within 6 months of the visa grant date and have to work for the same employer for at least 2 years.
