BREAKING NEWS! New Legislation to Define Permanent Residency for New Zealand Citizens
On 12 December 2022, the Australian Government announced new legislation to define Permanent Residency for New Zealand citizens in Australia. The new legislation will commence on 1 January 2023.
The new legislation was made under subsection 5(2) of the Australian Citizenship Act 2007. The new legislation provides a more straightforward pathway to permanent residency for New Zealand citizens in Australia and will ease them to obtain Australian citizenship.

Permanent Residency for New Zealand Citizens in Australia
- New Zealand citizens who currently hold a Special Category Visa or Special Purpose Visa are Australian permanent residents, if:
- The person is ordinarily resident in Australia; or
- The person holds a special category visa based on their status as an airline crew member or an airline positioning crew member and is ordinarily resident in Australia.
- New Zealand citizens who were holders of protected SCV are Australian Permanent Residents if, immediately before last leaving Australia, the person:
- Was a holder of a special category visa;
- Was a holder of a special purpose visa granted based on the person’s status as an airline crew member or an airline positioning crew member; and
- Is not outside Australia because the person was removed or deported from Australia
- New Zealand Citizens who previously held special category visas with the below conditions are considered Permanent Residents from 01 January 2022:
- holder of a subclass 189 New Zealand stream, granted after 31 December 2021 and before 01 July 2023 as a primary visa holder
- holder of subclass 189 New Zealand stream and meets the secondary criteria and is a member of the family unit of the primary visa holder
Does it apply to All New Zealand Citizens?
The new permanent residency for New Zealand citizens in Australia does not apply to those New Zealand citizens in Australia as Diplomatic or Consular Representatives of New Zealand.
It also does not apply to their spouse or dependent child.
