If a migration agent is operating from outside of Australia and is not registered by any matter of the word, he or she is not obligated to operate by the code of conduct above. The agent would not be bided by any laws or regulations.
Any migration agencies outside of Australia cannot be closely governed by any authoritative body including the Office of the Migration Agents Registration Authority (Office of the MARA) or the Department of Home Affairs enabling the agent offshore to act in unlawful ways and effectively get away with it.
Australian Migration agents based offshore have been known to present a false profile to consumers in the past, commit fraud and take advantage of the willingness and determination some people present in migrating to Australia. When this happens, there is no action the Australian Government or any regulatory body can take.
